What this Policy Covers
This policy explains what the DropZone Pro licence covers, how updates and Premium Support work, and when related services need separate scope.
This policy explains what the DropZone Pro licence covers, how updates and Premium Support work, and when related services need separate scope.
DropZone Pro is a Kayak-owned HubSpot website system licensed for use in an approved client HubSpot portal.
Once payment has been received and applicable terms have been met, the client receives a perpetual, non-transferable, non-sublicensable licence to use the installed DropZone Pro system for their own website and internal business purposes.
That licence covers the installed version and configuration. It does not include perpetual updates, perpetual support, future products, new services, resale rights, redistribution rights, or the right to copy DropZone Pro into another HubSpot portal, platform, business, brand, or client environment.
This policy applies specifically to DropZone Pro. It works alongside Kayak’s General Service Agreement, applicable statements of work, proposals, invoices, and support terms.
Kayak’s General Service Agreement /legal
If this policy conflicts with a signed statement of work or written agreement, the signed agreement controls unless otherwise stated in writing.
This policy does not replace Kayak’s Privacy Policy. Privacy, data, cookies, website usage, and related matters are addressed separately.
Kayak’s Privacy Policy /privacy
Unless otherwise stated in writing, a standard DropZone Pro licence is for use in one approved client HubSpot portal, with one installation of the applicable current DropZone Pro theme components and one brand configuration.
The HubSpot portal, HubSpot subscription, HubSpot fees, HubSpot user seats, HubSpot billing, and HubSpot platform access are separate from the DropZone Pro licence and remain the client’s responsibility.
The licence may cover theme files, page templates, system templates, blog templates, modules, global modules, theme settings, layout patterns, schema-enabled modules, documentation, and configuration work included in the applicable agreement.
Migration, training, page building, strategy, audits, redesigns, and custom development are additional unless specifically scoped.
The DropZone Pro licence activates on the date payment is received, unless otherwise stated in writing.
The initial 12-month update entitlement begins on the licence activation date.
Delayed installation, deferred website application, delayed migration, delayed launch, continued use of an external website platform, or client-side timing delays do not extend the initial update entitlement unless Kayak agrees to that in writing.
Kayak (Kayak Creative Services inc.) owns DropZone Pro.
This includes the theme code, templates, modules, global modules, system templates, layout patterns, schema structures, configuration methods, documentation, update path, design system, implementation methods, and related intellectual property.
The client owns its own content, data, copy, images, brand assets, trademarks, business materials, and other client-provided materials.
The client does not own DropZone Pro itself and may not resell, redistribute, sublicense, copy, transfer, publish, share, or recreate DropZone Pro for another business, brand, portal, platform, agency, or client.
After payment has been received and applicable terms have been met, the client may use the installed DropZone Pro system in the approved HubSpot portal for their own website and internal business purposes.
The client may create and edit website content using the normal HubSpot page editing tools, modules, settings, content areas, and configuration options made available to them.
The client may not copy DropZone Pro into another HubSpot portal, sell access to it, provide it to another agency or developer for reuse, create a derivative theme for resale, or use it to build websites for unrelated businesses or third-party clients.
Kayak may work with referral partners, sales partners, HubSpot partners, agencies, or other approved collaborators.
Partner or referral involvement does not change the DropZone Pro licence. DropZone Pro remains Kayak-owned intellectual property, and the licence remains limited to the approved client HubSpot portal, installation, and brand configuration described in the applicable agreement.
Partners and referral sources are not authorized to copy, modify, redistribute, resell, sublicense, document, represent, or support DropZone Pro as their own product or system.
Partners may not represent independently produced materials, recommendations, screenshots, demonstrations, training, or documentation as official DropZone Pro standards, product capabilities, legal terms, warranty terms, or support commitments.
Kayak remains responsible for Kayak-scoped DropZone Pro implementation, warranty, and support. Any partner-provided services, strategy, content, design, RevOps, marketing, or related work remain subject to the partner’s own agreement with the client unless Kayak has specifically included that work in writing.
Clients may make normal content edits in HubSpot. This includes editing copy, images, page content, links, calls to action, basic styling options, and standard page settings available through normal HubSpot editing tools.
Structural and system-level changes are different. Kayak is responsible for changes to theme files, template structure, module code, custom module behaviour, global system configuration, custom development, and template-level or module-level implementation.
Changes made by the client, another agency, a developer, a contractor, HubSpot user, or third party may affect warranty coverage, support eligibility, update eligibility, and system behaviour.
DropZone Pro may include advanced HubSpot modules, page templates, layout patterns, global modules, theme settings, reusable content structures, schema-enabled modules, and system templates.
DropZone Pro is designed to help pages remain more consistent over time, reduce layout drift, support day-to-day editing, and improve the structure used for SEO, AEO, and AI discoverability.
DropZone Pro supports marketing teams that create, revise, and publish pages regularly. It is not a generic DIY marketplace theme.
Where supported by the client’s HubSpot subscription and portal configuration, DropZone Pro may include HubSpot system templates and blog templates configured by Kayak.
These may include templates for 404 pages, error pages, search results, password-protected content, subscription-related pages, blog listing pages, blog article pages, and other HubSpot-controlled page types required for a complete website experience.
These templates are part of the licensed DropZone Pro system when installed or configured by Kayak. The client receives the same limited right to use them in the approved HubSpot portal as they receive for the rest of the installed DropZone Pro system.
If the client is not yet using HubSpot as the primary website platform, some system templates, blog templates, and website-specific templates may be installed, configured, prepared, or held for future use but not fully applied until the relevant HubSpot website, blog, domain, content, or subscription setup is active.
DropZone Pro is built for use within HubSpot and depends on the client’s HubSpot subscription, portal configuration, permissions, connected domains, available HubSpot features, and HubSpot’s ongoing platform behaviour.
Kayak generally does not install or apply DropZone Pro in a HubSpot portal that lacks the prerequisite configuration needed for the intended use.
However, where a client uses HubSpot for marketing, landing pages, blog, CRM, or related tools while maintaining a separate WordPress or other website, Kayak may still licence, install, and configure supported DropZone Pro components in the client’s HubSpot portal.
In that situation, Kayak may apply the parts of DropZone Pro that are usable within the client’s current HubSpot setup and defer website-specific application, launch, migration, or activation work for up to 12 months from the licence activation date.
Deferred work after that period may require Premium Support, additional support time, or a separately estimated project, depending on the scope, timing, portal condition, HubSpot requirements, and work required.
Some DropZone Pro components may not be applied immediately.
Deferred application may include page templates, system templates, blog templates, conversion layouts, Brand Templates, modules, global modules, search templates, error templates, or other website-specific components that cannot be fully used until the client’s HubSpot subscription, domain setup, blog setup, website migration, content readiness, or portal configuration supports them.
Deferred application does not mean Kayak has failed to deliver the licence. It means the licensed system or applicable components are available for use when the required HubSpot conditions are met.
Unless a statement of work says otherwise, future application of deferred components may require paid support, Premium Support, additional support time, or a separately estimated project, depending on the scope, timing, portal condition, HubSpot changes, and work required.
Kayak is not responsible for limitations, interruptions, feature changes, permission changes, product changes, subscription changes, or platform behaviour controlled by HubSpot.
If HubSpot changes its platform, subscription packaging, permissions, development tools, CMS features, security requirements, or content editing behaviour in a way that affects DropZone Pro, Kayak will make reasonable efforts to support eligible licensed clients within the terms of their active warranty, update period, or support plan.
Work required because of HubSpot platform changes, client subscription limits, portal restrictions, third-party changes, or delayed implementation may require Premium Support, additional support time, a HubSpot subscription change, or a separately estimated project.
DropZone Pro depends on the client’s HubSpot subscription, portal configuration, permissions, connected domains, available HubSpot features, and HubSpot’s ongoing platform behaviour.
If the client downgrades, changes, removes, or fails to maintain a HubSpot subscription, feature, permission, domain setup, or portal configuration required for DropZone Pro to function as installed, some parts of the system may stop working, become unavailable, or require reconfiguration.
In that situation, Kayak’s warranty, update support, and service obligations may be limited or paused for the affected components until the required HubSpot access, subscription, feature, or configuration is restored.
If HubSpot materially changes, removes, restricts, or replaces platform features that DropZone Pro depends on, Kayak will make reasonable efforts to support eligible clients within the terms of their active warranty, update period, Premium Support period, or support agreement.
Work required because of HubSpot platform changes, subscription changes, portal downgrades, lost features, permission changes, or changed configuration may require Premium Support, additional support time, a HubSpot subscription change, or a separately estimated project.
A client’s licence to use the installed DropZone Pro system does not guarantee that HubSpot will continue to support every feature, template, module, permission, subscription level, or platform behaviour required by the installed version.
Kayak uses HubSpot Partner Admin access to install, configure, support, update, and maintain DropZone Pro and Kayak-built website work inside the client’s HubSpot portal.
Partner Admin access is provided through HubSpot’s partner access system and does not require the client to purchase an additional paid HubSpot seat for Kayak.
Partner Admin access gives Kayak the permissions needed to support the client’s HubSpot website, theme, templates, modules, content structure, CRM objects, marketing assets, workflows, and related configuration where those services are included in the applicable agreement or support plan.
HubSpot limits Partner Admin access in important ways. Partner Admins cannot add or remove the client’s own Super Admins, change the client’s billing or financial settings, or manage classified Sensitive Data. Those controls remain with the client and HubSpot.
Kayak’s warranty for DropZone Pro, Kayak-built theme work, custom modules, templates, and related implementation work depends on Kayak maintaining appropriate HubSpot Partner Admin access to the client’s HubSpot portal.
If the client removes, blocks, downgrades, or materially restricts Kayak’s Partner Admin access, Kayak may be unable to inspect, update, troubleshoot, secure, or maintain the installed system. In that case, warranty coverage, update support, and related support eligibility may be suspended until access is restored.
If access is restored after being removed or restricted, Kayak may need to review the portal, theme files, templates, modules, settings, and related implementation before reinstating support or warranty coverage.
Any review, repair, reconfiguration, correction, or support required because of access restrictions, unauthorized changes, third-party work, client-side modifications, portal changes, or altered theme components may be billed as additional support.
Where warranty coverage applies, Kayak may choose the appropriate remedy.
This may include repair, replacement, reconfiguration, patching, updating, advising the client, applying a reasonable workaround, or making proactive refinements to affected components.
Kayak may also proactively refine or improve DropZone Pro components to maintain compatibility, improve performance, correct minor issues, or improve system behaviour.
In some cases, minor patches or refinements may be applied without formal client notice. In other cases, Kayak may notify the client before accessing the portal, applying updates, changing configuration, or completing more visible work.
Kayak’s warranty does not guarantee uninterrupted operation, HubSpot platform behaviour, third-party compatibility, legal compliance, accessibility compliance, search rankings, AI citations, traffic, conversions, revenue, or business outcomes.
The client remains responsible for controlling access to its HubSpot portal.
Kayak is not responsible for issues caused by unauthorized changes, third-party edits, client-side code changes, copied or modified theme files, altered templates, changed modules, deleted assets, broken dependencies, changed permissions, or changes made outside Kayak’s approved implementation process.
Kayak will only perform work that is authorized by the client, covered by an agreement, requested by an approved contact, or reasonably required to support, maintain, troubleshoot, update, or protect Kayak-installed work.
Performing unauthorized work inside a client portal would violate Kayak’s operating standards and damage the trust required for partner access.
For the first 12 months after licence activation, the client is entitled to announced eligible DropZone Pro updates that Kayak makes available to licensed DropZone Pro customers.
This update entitlement depends on the client maintaining required HubSpot Partner Admin access and the installed system not being materially altered outside Kayak’s approved process.
Eligible updates may include theme refinements, module improvements, template updates, compatibility improvements, SEO-related improvements, AEO-related improvements, schema improvements, usability updates, bug fixes, or other improvements Kayak makes available to eligible DropZone Pro licence holders.
The update entitlement does not mean every prior component remains supported indefinitely, every new component is automatically included, or every update can be applied to every portal without additional configuration, support time, subscription changes, or separate scoping.
Kayak may refine, improve, combine, replace, rename, sunset, patch, or introduce DropZone Pro components over time.
This may include changes to modules, templates, layouts, global modules, system templates, schema structures, settings, controls, or related functionality.
A client may continue using installed components under their licence, subject to HubSpot compatibility and the terms of this policy. However, Kayak is not required to support every prior component indefinitely or maintain deprecated components where a newer component, safer approach, better structure, or replacement method is available.
If an installed component is replaced, deprecated, or materially changed, support or update work may involve replacing the older component with a newer supported approach.
After the initial 12-month update period, access to current DropZone Pro updates requires the purchase of Premium Support.
Premium Support is available only to clients with a DropZone Pro licence.
Clients are not required to purchase Premium Support. Clients are also not required to renew Premium Support each year. A client may skip one or more years and later purchase Premium Support to access eligible current DropZone Pro updates, modules, templates, refinements, and major improvements available at that time.
Premium Support does not reinstate support for altered, damaged, copied, deprecated, unsupported, or materially changed implementations without review. Kayak may require paid review, cleanup, repair, reconfiguration, or additional support before applying updates to an older or modified installation.
Premium Support is an optional annual purchase for DropZone Pro licence holders.
Each Premium Support purchase covers a 12-month support period and includes access to eligible current DropZone Pro updates plus a 10-hour support block.
The support block is typically used shortly after purchase to apply updates, review the installation, adjust branding or configuration, and complete theme-related support work.
Any unused time may be used until the end of the applicable 12-month Premium Support period. Unused time does not carry forward unless Kayak agrees in writing.
Additional support time may be purchased through Kayak’s 10-hour support block option.
Premium Support does not automatically renew unless expressly agreed in writing.
Premium Support is intended for DropZone Pro updates, theme-related support, configuration review, branding adjustments, and related implementation help within the available support time.
Larger projects, strategic services, custom configuration, content work, migrations, redesigns, audits, training, or new system builds are estimated separately unless they are specifically included in a written agreement.
This may include work such as Brand Templates, Conversion System layouts, dynamic pages, knowledge base configuration, multilingual setup, smart content preparation, SEO/AEO audits, full migrations, or major website restructuring.
Kayak’s goal is to recommend the DropZone Pro configuration, add-on, or service that best fits the client’s actual need.
In some cases, this may mean recommending a different option than the one the client initially asks about. For example, a client may ask about the Conversion System when their existing content, sales process, or page structure would be better supported by one or more Brand Templates.
In other cases, Kayak may recommend deferring a feature, using a simpler configuration, avoiding unnecessary custom work, or choosing a lower-cost option where that better supports the client’s goals.
These recommendations are intended to reduce unnecessary cost, limit rework, preserve useful existing content or workflows, and help the client get the right level of structure for the way they already work.
Kayak may decline, defer, or recommend alternatives to requested work if we believe the requested approach would create unnecessary complexity, poor fit, avoidable cost, implementation risk, maintenance issues, or outcomes that are not in the client’s best interest.
A Brand Template is an additional page layout built into the client’s DropZone Pro system when the existing layouts do not quite fit a specific page type or business need.
Brand Templates use the same system, modules, and structure rules, but arrange them differently to support a recurring content pattern. A Brand Template becomes a selectable layout the client’s team can use. It is not a one-off workaround.
Brand Templates are not automatically included in the standard DropZone Pro licence, Premium Support block, or update entitlement unless specifically scoped.
When purchased and installed, a Brand Template becomes part of the client’s licensed DropZone Pro system for the approved HubSpot portal and brand configuration. Kayak retains ownership of the underlying DropZone Pro system, methods, modules, templates, and implementation approach.
The Conversion System is a structured page layout approach for sales, service, campaign, or conversion-focused pages.
The Conversion System is not automatically included in the standard DropZone Pro licence, Premium Support block, Brand Template work, or update entitlement unless specifically scoped.
In some cases, the Conversion System may be the right option. In other cases, one or more Brand Templates may better support the client’s existing content, sales process, internal workflow, or page structure with less rework.
Kayak may recommend the option that better fits the client’s actual need, even when that differs from what the client initially asks to purchase.
In some cases, a single DropZone Pro installation may support more than one brand, business unit, or website domain within the same HubSpot portal.
This is not included by default and must be approved and scoped by Kayak.
Each additional brand or domain requires separate configuration. At minimum, this may include its own child theme setup, global modules, brand settings, navigation, footer configuration, shared content areas, and related implementation work.
A multi-brand or multi-domain setup does not create separate ownership of DropZone Pro and does not permit copying, transferring, sublicensing, or reusing DropZone Pro outside the approved HubSpot portal or approved brand/domain configuration.
For update and upgrade purposes, each approved brand/domain configuration is treated as a separate supported implementation.
If Premium Support is purchased for a multi-brand or multi-domain installation, Premium Support must be purchased for each approved brand/domain configuration at the same time.
This applies even if the update is not actively applied to every domain at the same time. Because updated DropZone Pro components, modules, templates, and theme files may be installed in the shared portal and accessible to each configured brand/domain, the update entitlement and support requirement apply to the full multi-brand or multi-domain installation.
HubSpot knowledge base areas, customer help centres, documentation sections, and similar microsite-style experiences are not automatically included in a standard DropZone Pro installation or configuration.
A knowledge base may use separate templates, navigation, content structures, search behaviour, categories, article layouts, access settings, and customer support workflows.
Because these areas function more like a microsite than a standard website page, they require separate scoping, planning, configuration, design, and support.
Where separately estimated, Kayak may configure or design knowledge base pages to align with the client’s DropZone Pro brand configuration. That work does not make knowledge base configuration part of the standard DropZone Pro licence, included update period, Premium Support block, Brand Template, or Conversion System unless expressly stated in writing.
DropZone Pro can support HubSpot dynamic page creation where the client’s HubSpot subscription, data structure, HubDB setup, CRM object structure, permissions, and content model allow it.
Dynamic pages are not automatically included in a standard DropZone Pro installation, configuration, Brand Template, Conversion System layout, Premium Support block, or update entitlement.
Because dynamic pages depend on structured data, page logic, template configuration, content relationships, filtering, URL patterns, and client-specific requirements, they require separate scoping and custom configuration.
Where separately estimated, Kayak may configure dynamic pages using DropZone Pro templates, modules, or supporting assets. That work remains subject to the approved statement of work, HubSpot subscription requirements, client data readiness, and any additional support or maintenance terms that apply.
DropZone Pro may support HubSpot smart content, personalization, multiple-language pages, translated content, language switchers, and related content-variation features where the client’s HubSpot subscription, portal setup, content structure, and implementation requirements allow it.
These features are not automatically included in a standard DropZone Pro installation, configuration, Brand Template, Conversion System layout, Premium Support block, or update entitlement.
Because smart content, personalization, and multiple-language implementation depend on client-specific rules, audience segments, content variations, translation requirements, URL structure, navigation logic, SEO requirements, and HubSpot configuration, they require separate scoping and custom configuration.
Where separately estimated, Kayak may prepare or configure DropZone Pro templates, modules, navigation, layouts, or supporting assets for smart content, personalization, or multiple-language use. That work remains subject to the approved statement of work, HubSpot subscription requirements, client content readiness, and any additional support or maintenance terms that apply.
In some cases, the client may use HubSpot for marketing, CRM, landing pages, blog, or campaign assets while maintaining a WordPress or other external website.
Where separately scoped, Kayak may design or configure an external website to visually align with the client’s DropZone Pro brand configuration.
This work does not transfer DropZone Pro to WordPress or any other non-HubSpot platform. DropZone Pro remains a HubSpot-based licensed system.
Any WordPress or external website work is a separate service and is governed by the applicable statement of work, platform terms, support terms, and warranty limits.
A visually matched WordPress website may use similar brand styling, layout direction, spacing, typography, content patterns, or design guidance, but it does not include a licence to copy, redistribute, recreate, or modify DropZone Pro theme code, HubSpot modules, HubSpot templates, or Kayak’s proprietary HubSpot implementation methods outside HubSpot.
DropZone Pro may be used with third-party materials, third-party tools, HubSpot tools, client-provided assets, stock assets, fonts, scripts, integrations, apps, plugins, or embedded services.
Third-party materials remain governed by their own licence terms, platform terms, subscription terms, and usage restrictions.
The client is responsible for ensuring it has the right to use client-provided materials, third-party materials, fonts, images, content, data, integrations, and other assets included in its website.
DropZone Pro is designed to support stronger website structure, content consistency, module-level organization, schema use, SEO, AEO, and AI discoverability.
These are implementation features and structural advantages. They are not guarantees.
Kayak does not guarantee search rankings, AI citations, traffic, conversions, accessibility compliance, legal compliance, revenue, lead volume, or business outcomes from the use of DropZone Pro.
SEO audits, AEO audits, accessibility audits, content strategy, technical remediation, content rewriting, and larger-scale optimization work are separate services unless specifically scoped.
Kayak supports the DropZone Pro system, implementation, theme-related issues, template-related issues, module behaviour, structural configuration, and Kayak-built work within the applicable warranty, update period, support block, Premium Support period, or statement of work.
HubSpot platform issues, HubSpot billing, HubSpot product limits, HubSpot outages, HubSpot subscription changes, HubSpot-controlled permissions, HubSpot-controlled feature changes, and native HubSpot tool behaviour may need to be addressed with HubSpot directly unless Kayak is separately engaged to assist.
Day-to-day content editing remains the client’s responsibility unless support, training, or content services are specifically included.
Kayak may pause support, updates, warranty coverage, or further work if payment is overdue, required access is removed or restricted, the client materially alters the installed system, third-party work affects the installation, HubSpot subscription limits prevent the work, or the client uses DropZone Pro outside the approved licence scope.
Pausing support or warranty coverage does not remove the client’s licence to use the installed version of DropZone Pro in the approved HubSpot portal, provided payment has been received and the client remains within the permitted licence scope.
However, paused support, expired update eligibility, removed access, unsupported changes, or altered implementations may prevent Kayak from maintaining, updating, repairing, or supporting the system without additional paid work.
Clients with questions about their DropZone Pro licence, update eligibility, Premium Support options, Partner Admin access, warranty coverage, or additional configuration needs should contact Kayak before making structural changes or engaging another provider to modify the installed system.
This helps protect the installation, reduce rework, and clarify whether the requested work is included, supportable, or separately scoped.
